1. Acceptance and Scope

These Terms of Use and Legal Notices ("Terms") form an agreement between you and LiberaNt LLC ("LiberaNt," "we," "us") governing your access to NTsocial applications, NTsocial MeshLink, related companion features, documentation, and the official website (collectively, the "Services"). Explicit acceptance of the Terms of Use and Community Safety Agreement is required before identity setup, login, or first communication use. These Legal Notices also apply together with our Privacy Policy, and our Community Standards. If you do not agree, do not use the Services.

Additional terms from Apple, Google, a device manufacturer, radio provider, open-source license, or selected third-party service may apply. Mandatory platform or consumer terms control to the extent they cannot lawfully be excluded.

2. What NTsocial Is—and Is Not

NTsocial is a social platform combining Internet messaging through Cloudflare with native nearby BLE mesh, direct Wi-Fi synchronization, and optional gateways. Internet is on by default and can be turned off in Profile. Features and delivery depend on network access, participating devices, permissions, radio conditions, operating-system scheduling, batteries, and required accessories. A nearby online device is not a general Internet gateway for other users.

Not an emergency service: NTsocial does not connect you to emergency dispatch, does not guarantee delivery, receipt, identity, range, availability, background operation, or data recovery, and must not be your only means of requesting emergency, medical, public-safety, or life-critical assistance. Contact local emergency services through an appropriate channel when needed.

3. Eligibility and Children

You must be legally capable of accepting these Terms. The Services are not directed to children under 13. If local law requires parental or guardian authorization for a minor to use the Services or consent to data handling, that authorization is required. Do not use the Services if applicable law prohibits you from doing so.

4. Responsible Use and Community Safety

You are responsible for your conduct, the content you create or transmit, the channels and secrets you share, and compliance with applicable law. You must not use the Services to threaten, harass, exploit, defraud, impersonate, distribute malware or spam, disclose another person's private information without authority, infringe rights, facilitate unlawful activity, or interfere with devices, networks, or the Services.

The Terms of Use and Community Standards establish our zero-tolerance rules, required filtering, reporting and blocking safeguards, and moderation action within 24 hours of receiving an abuse report. Confirmed violations require content removal and offender ejection or suspension from our operated services. Independently held offline copies cannot all be remotely erased; this does not waive our moderation obligation.

5. User Content and Other Participants

You retain whatever rights you lawfully hold in content you create. You direct the App to copy, transmit, relay, store, display, transform for transport, or export that content as needed to perform the feature you choose. You represent that you have the necessary rights and permissions to do so.

Public and channel content is intended for participating recipients. Nearby devices may relay content, and recipients may save, copy, screenshot, export, or forward it. LiberaNt does not endorse user content, verify every identity, continuously monitor decentralized traffic, or control the conduct of nearby users. Use judgment before sharing confidential, regulated, location, or safety-sensitive information.

6. Encryption and Security Limitations

Internet private messages require automatic DM2 or manual shared-secret end-to-end protection. Automatic DM2 uses identity keys learned through verified nearby exchange or the authenticated Cloud directory and pins the first accepted key; this does not verify a real-world identity. A changed pinned identity blocks sending and Basic1 downgrade. Shared secrets must be exchanged and checked through a trusted channel.

The legacy nearby Basic1 mode uses an app-embedded key and is not end-to-end encryption, sender authentication, or forward secrecy. A person with that key may be able to decrypt or forge Basic1 content. Public posts remain public regardless of transport encryption. Encryption cannot prevent recipient disclosure or protect a compromised device, and no security control is warranted to be invulnerable.

7. Optional Features and Third-Party Services

Optional integrations—including MeshLink, Meshtastic or LoRa radios, Wi-Fi Aware, Wi-Fi Direct, hotspots, LAN peers, map files, and Android UTFind—may require separate software, hardware, credentials, permissions, consent, connectivity, or provider terms. When you enable one, information necessary for that feature is disclosed to the selected device, peer, companion, or provider.

LiberaNt does not control third-party networks or services and is not responsible for their availability, security, content, retention, or independent acts. Your use of them is governed by their terms and privacy notices in addition to these Terms.

Internet messaging uses Cloudflare to process messages, images, and online presence. Internet is enabled by default and can be turned off in Profile. The Privacy Policy describes the data and retention for these services.

8. Local Data, Backups, and Deletion

The App may persist identities, messages, media, keys, settings, locations, diagnostics, and delivery state locally. Closing the App does not necessarily delete them. Deletion controls act on App-owned data on the device where you invoke them; operating-system backups, exported copies, reports already sent, and copies stored by peers or third parties may remain. You are responsible for backups and for safeguarding your device, credentials, and shared secrets.

Cloud message payloads and image ciphertext have a configured 30-day lifetime. Public identity keys, trust records, infrastructure logs, and temporary People registrations are handled separately. Turning Internet off does not erase all history or recall content from other devices. See the Privacy Policy.

9. Intellectual Property and License

The brand, design, and LiberaNt-provided website materials are owned by or licensed to LiberaNt. Software rights are governed by the open-source license supplied with each repository, release, and component. These notices do not restrict rights granted by those licenses. See the Terms of Use for the distinction between software rights and access to our operated services.

Third-party and open-source components remain governed by their respective licenses and notices. Except where those licenses or mandatory law permit it, you may not copy, sell, sublicense, distribute, defeat access controls, or exploit LiberaNt materials without written permission. Nothing in these Terms transfers ownership of your lawful user content to LiberaNt.

10. Changes, Suspension, and Discontinuation

We may add, change, limit, suspend, or discontinue features, compatibility, documentation, or company-controlled services. Updates may be needed for security or interoperability. Decentralized copies already installed may continue operating beyond our control, and we cannot promise support for every prior version, platform, radio, or protocol combination.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available". LiberaNt and its licensors disclaim express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, delivery, interoperability, and security. We do not warrant that messages will be delivered, that peers are who they claim to be, that content is lawful or safe, or that the Services will be uninterrupted or error-free.

Some jurisdictions do not allow particular warranty exclusions. Nothing in these Terms excludes non-waivable rights or remedies.

12. Limitation of Liability

To the maximum extent permitted by law, LiberaNt, its affiliates, officers, employees, developers, contributors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, communications, opportunity, or service, arising from the Services or these Terms—even if advised that such loss is possible.

Nothing in these Terms limits liability that cannot lawfully be limited, including where applicable liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, U.S.A., without regard to conflict-of-law rules. Subject to mandatory consumer law and any non-waivable right to bring a claim elsewhere, disputes shall be brought in a state or federal court with jurisdiction in Wyoming. Before filing a claim, you and LiberaNt are encouraged to attempt informal resolution by email.

14. General Terms

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, or sale of the relevant business, subject to applicable law. These Terms, the Privacy Policy, Community Standards, applicable platform terms, and incorporated licenses form the agreement regarding the Services.

15. Changes and Contact

We may update these notices as the Services or law change, publish the updated date, and provide legally required notice. Material changes to the Terms of Use require renewed explicit acceptance before further use of affected communication features.

一、接受條款與適用範圍

本使用條款與法律聲明（下稱「本條款」）是您與 LiberaNt LLC（下稱「LiberaNt」或「我們」）間的協議，適用於 NTsocial App、NTsocial MeshLink、相關 companion 功能、說明文件及官方網站（合稱「本服務」）。建立身分、登入或首次通訊前，須明確同意使用者條款與社群安全協議。本法律聲明亦應與隱私權政策及社群規範一併閱讀；若不同意，請勿使用。

Apple、Google、裝置製造商、radio 提供者、開放原始碼授權或您選擇的第三方服務可能另有條款。依法不能排除的平台或消費者強制規定，在必要範圍內優先適用。

二、NTsocial 是什麼，以及不是什麼

NTsocial 是整合 Cloudflare 網際網路通訊、原生附近 BLE 網狀網路、直連 Wi-Fi 同步及選用閘道的社群平台。Internet 預設開啟，可在個人檔案關閉。功能與傳遞取決於網路、參與裝置、權限、無線環境、系統排程、電池及必要配件。附近在線裝置並非其他使用者的通用網際網路閘道。

不是緊急服務：NTsocial 不會將您連接至緊急派遣單位，不保證送達、收件、身分、範圍、可用性、背景運作或資料復原，亦不得作為尋求緊急、醫療、公共安全或攸關生命協助的唯一方式。必要時請透過適當管道聯絡當地緊急服務。

三、使用資格與兒童

您必須具備接受本條款的法律能力。本服務並非以 13 歲以下兒童為對象。若當地法律要求未成年人使用本服務或同意資料處理時須取得父母或監護人授權，即必須先取得該授權。若適用法律禁止您使用，請勿使用本服務。

四、負責任使用與社群安全

您應對自己的行為、建立或傳送的內容、分享的頻道與密鑰，以及遵守適用法律負責。您不得利用本服務進行威脅、騷擾、剝削、詐騙、冒充、散播 malware／spam、未經授權揭露他人私密資訊、侵害權利、協助違法活動，或干擾裝置、網路與本服務。

使用者條款及社群規範明定零容忍、必要的過濾、檢舉及封鎖保護，以及收到檢舉後 24 小時內採取管理措施。確認違規時，須移除營運服務上的內容並踢除或停權違規者。無法遠端抹除所有獨立離線副本，不免除管理義務。

五、使用者內容與其他參與者

您保留對自己合法建立內容所享有的權利。您指示 App 為完成所選功能而對內容進行必要的複製、傳輸、中繼、保存、顯示、傳輸格式轉換或匯出，並聲明已取得必要權利與許可。

公開及頻道內容是供參與收件人閱讀。附近裝置可能中繼內容，收件人亦可能保存、複製、截圖、匯出或轉傳。LiberaNt 不為使用者內容背書、不驗證每個身分、不持續監看去中心化流量，也不控制附近使用者的行為。分享機密、受管制、定位或安全敏感資訊前，請自行審慎判斷。

六、加密與安全限制

網際網路私訊要求自動 DM2 或手動共享密語的端到端保護。自動 DM2 使用已驗證的附近交換或需驗證的雲端目錄取得身分金鑰，並信任首次接受的金鑰；這不等於真實身分核驗。已信任的身分金鑰變更時，會阻擋傳送及降級至 Basic1。共享密語應透過可信任管道交換並核對。

舊版附近 Basic1 模式使用 App 內建金鑰，不是端到端加密、發送者驗證或前向保密；取得該金鑰的人可能解密或偽造其內容。公開貼文不會因傳輸加密而變成私密內容。加密不能防止接收者再揭露或保護已遭入侵的裝置，我們不保證任何安全措施絕無漏洞。

七、選用功能與第三方服務

MeshLink、Meshtastic／LoRa radio、Wi-Fi Aware、Wi-Fi Direct、hotspot、LAN peer、地圖檔及 Android UTFind 等選用整合，可能需要額外軟硬體、credential、權限、同意、網路或提供者條款。啟用時，完成該功能所需資訊會提供給您選擇的裝置、peer、companion 或提供者。

LiberaNt 不控制第三方網路或服務，亦不對其可用性、安全、內容、保存或獨立行為負責。使用該等服務時，除本條款外亦受其條款與隱私聲明拘束。

網際網路通訊透過 Cloudflare 處理訊息、圖片及在線狀態。Internet 預設開啟，可在個人檔案關閉。這些服務的資料與保存方式詳見隱私權政策。

八、本機資料、備份與刪除

App 可能在本機持續保存身分、訊息、媒體、金鑰、設定、位置、診斷與傳遞狀態。關閉 App 不代表資料會刪除。刪除控制只處理您執行操作之裝置上的 App 自有資料；OS 備份、已匯出副本、已寄送報告及 peer／第三方保存的副本可能繼續存在。您應自行負責備份並保護裝置、credential 與共享密鑰。

雲端訊息內容與圖片密文設定保存 30 天。公開身分金鑰、信任紀錄、基礎設施日誌與暫時 People 登記分別處理。關閉 Internet 不會清除全部歷史或收回其他裝置內容，詳見隱私權政策。

九、智慧財產與授權

品牌、設計及 LiberaNt 提供的網站素材由 LiberaNt 或其授權人擁有。軟體權利依各原始碼儲存庫、發行版本及元件隨附的開源授權規範，本聲明不限制該等授權授予的權利。軟體權利與營運服務存取權的區別請見使用者條款。

第三方及開放原始碼元件仍依各自授權與 notice 規範。除相關授權或強制法律允許外，未經書面許可，不得複製、出售、再授權、散布、規避存取控制或利用 LiberaNt 素材。本條款不會將您合法使用者內容的所有權移轉給 LiberaNt。

十、變更、暫停與停止

我們可能新增、變更、限制、暫停或停止功能、相容性、文件或公司控制的服務，亦可能因安全或互通性要求更新。已安裝的去中心化副本可能在我們無法控制的情況下繼續運作；我們不保證支援每個舊版本、平台、radio 或 protocol 組合。

十一、不提供保證

在法律允許的最大範圍內，本服務按「現況」及「現有」提供。LiberaNt 及授權人排除明示、默示與法定保證，包括適銷性、特定用途適用性、權利、不侵權、準確性、可用性、送達、互通性及安全。我們不保證訊息送達、peer 身分真實、內容合法安全，或本服務不中斷且無錯誤。

部分司法管轄區不允許特定保證排除；本條款不排除不得拋棄的權利或救濟。

十二、責任限制

在法律允許的最大範圍內，LiberaNt、關係企業、主管、員工、開發者、貢獻者及授權人，不對因本服務或本條款所生之間接、附帶、特殊、衍生、示範性或懲罰性損害，或利潤、收入、商譽、資料、通訊、機會或服務損失負責，即使已被告知可能發生。

本條款不限制依法不得限制的責任，包括適用時因詐欺、故意不法、重大過失、過失造成死亡或人身傷害，或消費者強制權利所生的責任。

十三、準據法與爭議

本條款以美國懷俄明州法律為準據法，不適用法律衝突規則。在消費者強制法律及不得拋棄之異地起訴權利的前提下，爭議應由對懷俄明州有管轄權的州或聯邦法院審理。提出訴訟前，鼓勵您與 LiberaNt 先透過 email 嘗試非正式解決。

十四、一般條款

若部分條款無法執行，應縮限至最低必要程度，其餘條款仍有效。未執行某條款不構成放棄。未經我們同意，您不得移轉本條款；我們得依法在合併、重組或相關業務出售時移轉。本條款、隱私權政策、社群規範、適用平台條款及納入的授權共同構成本服務的協議。

十五、條款變更與聯絡

我們可能隨本服務或法律變更更新本聲明、公布更新日期，並依法通知。使用者條款有重大變更時，須在繼續使用受影響的通訊功能前重新明確同意。

1. 同意と適用範囲

本規約は、LiberaNt LLC（以下「当社」）が提供する NTsocial、NTsocial MeshLink、関連アプリ・機能、文書、公式ウェブサイト（以下「本サービス」）に適用します。ID設定、ログイン、初回通信の前に利用規約とコミュニティ安全に関する合意への明示的な同意が必要です。本法的通知は、プライバシーポリシー、コミュニティ規範と合わせてお読みください。同意しない場合は利用しないでください。法令上排除できない消費者の権利や適用されるストア条件は維持されます。

2. NTsocial の機能と利用条件

NTsocial は Cloudflare によるインターネット通信、標準の近距離 BLE メッシュ、端末間 Wi-Fi 同期、任意のゲートウェイを組み合わせたソーシャルプラットフォームです。Internet は初期設定でオンで、Profile でオフにできます。機能と配信は接続、参加端末、権限、電波、OS の実行管理、電池、必要な機器に依存します。近くのオンライン端末は他の利用者向けの汎用インターネットゲートウェイではありません。

緊急通報サービスではありません：緊急機関への接続、配信、受信、身元、距離、可用性、バックグラウンド動作、データ復元を保証しません。緊急・医療・公共安全・生命に関わる支援の唯一の連絡手段にせず、必要な場合は適切な方法で地域の緊急機関へ連絡してください。

3. 利用資格と子ども

規約に同意する法的能力が必要です。13歳未満を対象としていません。未成年者の利用やデータ処理への同意に保護者の許可が必要な地域では、その許可を得てください。法令で禁じられる場合は利用できません。

4. 責任ある利用と安全

行動、作成・送信する内容、共有するチャンネルや秘密、法令遵守は利用者の責任です。脅迫、嫌がらせ、搾取、詐欺、なりすまし、マルウェアや迷惑情報の配布、無断の私的情報公開、権利侵害、違法行為の支援、端末・ネットワーク・サービスへの妨害に使わないでください。

利用規約とコミュニティ規範は、一切容認しない方針、フィルター・通報・ブロックの必要な保護、通報受領後24時間以内の管理対応を定めます。確認された違反では当社運営サービスの内容を削除し違反者を排除または停止します。独立した全オフラインコピーの遠隔消去はできませんが、管理義務は免除されません。

5. 利用者のコンテンツと参加者

作成した内容について適法に持つ権利は利用者に残ります。選んだ機能の実行に必要な複製、送信、中継、保存、表示、転送用変換、書き出しをアプリに指示するものとし、必要な権利と許可を持つことを表明します。

Public は近くの参加者と Internet 利用者が閲覧でき、チャンネルは対象の参加者に共有されます。受信者は保存、複製、撮影、書き出し、再転送できる場合があります。当社は投稿を支持せず、全員の身元を確認せず、分散通信を常時監視せず、他の利用者の行動を管理しません。機密、規制対象、位置、安全に関わる情報は慎重に共有してください。

6. 暗号化とセキュリティ

Internet の個別メッセージには、自動 DM2 または手動共有シークレットのエンドツーエンド保護が必要です。自動 DM2 は検証済みの近距離交換や認証付きクラウドディレクトリの身元鍵を使い、最初に受け入れた鍵を信頼します。実際の本人確認ではありません。信頼済みの鍵が変わると送信と Basic1 への切り替えを止めます。共有シークレットは信頼できる手段で交換・確認してください。

旧来の近距離 Basic1 はアプリ内の鍵を使い、エンドツーエンド暗号化、送信者認証、前方秘匿性ではありません。その鍵を持つ人は内容を解読・偽造できる場合があります。Public は通信を暗号化しても公開情報です。暗号化は受信者の再公開や侵害済み端末を防げず、安全対策に絶対的な保証はありません。

7. 連携機能と第三者サービス

Internet は Cloudflare を使ってメッセージ、画像、オンライン状態を処理します。Profile でオフにできます。MeshLink、Meshtastic／LoRa、Wi-Fi Aware／Direct、ホットスポット、LAN、地図ファイル、Android UTFind などの任意機能では、別のソフトウェア、機器、認証情報、権限、同意、接続、提供者条件が必要な場合があります。利用に必要な情報を選んだ端末、相手、連携アプリ、提供者に渡します。

当社は第三者のネットワークやサービスを管理せず、その可用性、安全、内容、保存、独立した行為に責任を負いません。本規約に加えて各提供者の規約とプライバシー通知が適用されます。

8. データ・バックアップ・削除

アプリは ID、メッセージ、メディア、鍵、設定、位置、診断、配信状態を端末に保存する場合があります。閉じても消えるとは限りません。端末の削除操作はその端末の対象データに作用し、OS バックアップ、書き出し、送信済み報告、他端末や第三者のコピーは残る場合があります。バックアップ、端末、認証情報、共有秘密の管理は利用者の責任です。

クラウドのメッセージと画像暗号文は30日間の保存設定です。公開身元鍵、信頼記録、基盤ログ、一時的な People 登録は別に扱います。Internet をオフにしても全履歴の削除や他端末からの回収にはなりません。詳細はプライバシーポリシーをご覧ください。

9. 知的財産とライセンス

名称、デザイン、当社のウェブ素材は当社または権利者に帰属します。ソフトウェアの権利は各リポジトリ、配布版、構成要素に付属するオープンソースライセンスで定まり、本通知はその権利を制限しません。ソフトウェアの権利と当社運営サービスへのアクセスの区別は利用規約をご覧ください。第三者のライセンスと通知は引き続き適用されます。利用者の適法なコンテンツの所有権は当社へ移転しません。

10. 変更・停止・終了

機能、互換性、文書、当社管理サービスを追加、変更、制限、一時停止、終了する場合があります。安全や相互運用のため更新が必要になることがあります。配布済みの分散アプリは管理外で動作し続ける場合があり、すべての旧版、端末、無線機、プロトコルの組合せのサポートを約束しません。

11. 保証の否認

法令が許す最大限の範囲で、本サービスを「現状のまま」「提供可能な範囲」で提供します。当社と許諾者は商品性、特定目的への適合性、権原、非侵害、正確性、可用性、配信、相互運用、安全を含む明示・黙示・法定保証を否認します。配信、相手の身元、内容の適法性や安全、中断や不具合のない動作を保証しません。

一部地域では特定の保証免除が認められません。放棄できない権利や救済を排除するものではありません。

12. 責任の制限

法令が許す最大限の範囲で、当社、関係会社、役員、従業員、開発者、貢献者、許諾者は、本サービスや規約から生じる間接的、付随的、特別、結果的、懲罰的損害、利益・収益・信用・データ・通信・機会・サービスの喪失について、可能性を知らされていた場合も責任を負いません。

詐欺、故意、重過失、過失による死亡や身体傷害、強行的消費者権など、適用法上制限できない責任を制限しません。

13. 準拠法と紛争

抵触法規則を除く米国ワイオミング州法を準拠法とします。強行的消費者法や他の場所で提訴する放棄不可の権利に従い、紛争はワイオミング州の管轄権ある州・連邦裁判所に提起します。提訴前にメールで非公式な解決を試みることを推奨します。

14. 一般条項

執行不能な条項は必要最小限に制限し、他の条項は有効です。不行使は権利放棄ではありません。当社の同意なく規約を譲渡できません。当社は適用法に従い、合併、再編、関連事業の売却に伴い譲渡できるものとします。本規約、プライバシーポリシー、コミュニティ規範、プラットフォーム条件、参照ライセンスが本サービスの合意を構成します。

15. 変更と連絡

サービスや法令に応じて通知を更新し、更新日を公開して法定の通知を行います。利用規約の重要な変更後は、影響する通信機能を続ける前に改めて明示的な同意が必要です。
